Referring to Section 172 of IPC, social activist Aires Rodrigues has approached the court seeking investigation against the convicted MLA, who is facing six months imprisonment for slapping a government official in 2006. Rodrigues said that the provision in the law provides for a punishment that may extend to six months. Rodrigues said that when a person, who has to attend court, absconds in order to avoid being served summons or notice or order, the law prescribes simple imprisonment for a term which may extend to six months, or with a fine which may extend to 1,000. Judge Pooja Kavlekar has asked for a reply in the matter from Colva PI Uttam Raut Dessai and has fixed the hearing of the case on Monday. On Thursday, police had informed the court that the legislator is absconding after they failed to execute an arrest warrant issued against him on April 9. Rodrigues has alleged that police have intentionally avoided seeking orders of the court to register an FIR for the offence of absconding so as to shield the politically-connected Pacheco. With the filing of this application before the court, fresh trouble seems to be brewing for Pacheco, who is on the run as per police records for the last several days.
