It would be in the interest of justice to see Goa CM Parsekar's answers to this article and perhaps he could advise us on the comments regarding his role in the Tiracol Golf Course and that of his wife Smita Parsekar being offered to function as Director of Leading Hotels. Shocking state of affairs that Goans vehemently oppose and condemn. For the CM of Goa to openly bat for Leading Hotels saying that no one is opposing the Tiracol Project is a blatant lie! This in the face of corporate terror attack on Tiracol in North Goa border on 14/15 May 2015 midnight. The village was attacked by 50 goons, cut down the trees that were legally prohibited to do so, then constructed the road and the work is still going on even today. What is shocking is that this terror attack was carried on with complete backing of Goa Chief Minister Laxmikant Parsekar who is elected from Mandrem Constituency. Tiracol is a village in Mandrem constituency. Even though villagers got the police involved to carry on pachanama in the night itself no FIR has been registered against those 50 goons involved in the terror attack. Laxmikant Parsekar, who is also Home Minister and controls police has instead made sure that the work on Tiracol site goes on unhindered and terror attack is condoned. "We have no order to stop work carried on by Leading Hotels in Tiracol. Case has been referred to the Permen Mamlatdar and to the Chief Town Planner" said Police Inspector Tushar Lotlikar attached to Pernem Police Station that has jurisdiction over Tiracol. This is a clear indicator of clear law and order failure in the State of Goa and In this case BMM calls upon President of India to dismiss the Goa government and impose President’s rule under the Article 356 of the Constitution of India. Bharat Mukti Morcha's ongoing investigations has revealed that one Ganguly came to Tiracol in 2006 and cheated people and fraudulently transferred the 12 lakh square meters of land in the name of his company. Then tried unsuccessfully to get approval of the Kerim - Tiracol Pachayat. Village Gram Sabha opposed the move to build Golf course and Luxury hotel villas in Tiracol. Ganguly then contacted Laxmikant Parsekar who was then just an MLA beside BJP party president. Parsekar struck a deal with Golf promoter Ganguly from Kolkata. The deal was as follows: BJP will come to power in Goa with full majority. Parsekar can give all the necessary permissions to construct Golf Course. But for this right away Ganguly has to fund Parsekar's elections from Mandrem constituency. Ganguly funded Parsekar's election campaign by putting in Rs.2 crore. Together with this Parsekar's wife Smita Parsekar was offered to function as Director of Leading Hotels replacing Sachin Parab, son of Sangeeta Parab, former MLA of Mandrem Constituency. Now perfect setting was in place. Husband is Chief Minister as well as Home Minister. Wife is a Director of Leading Hotels. We leave it in the hands of CBI to carry on further investigations. This much we came to know through reliable sources. All the permissions from State government including EIA was granted by BJP government ruled by Manohar Parrikar, current India's Defence Minister. It is most plausible that after National Green Tribunal and Administrative Tribunal via their respective orders made the possibility of implementation of the golf project impossible Director of the Leading Hotels consulted the Home Minister who is also a life partner, a husband. The way out that came out of the consultation is extra-constitutional strategy to deploy terror by 50 goons. Now after the terror attack on Tiracol Goa CM is adamant as he was in case of 108 agitation few months ago. In fact he is in a fix. For he has two formidable enemies in order to go for registration of FIR. First is his election funder Ganguly and second is his wife Smita who is company's director. In addition a prior understanding that public pressure will not exceed the permissible limits and this piece of information will never be shared and hence public will continue to be confused in dark - a sort of situation that arises in political situation of 'contended ignorance' as British Philosopher James Stuart Mill puts it. Your game is over Mr.CM. No one can fool all the people all the time. Your time is up. People of Goa are fed up of you (as you are serving the people of Goa as CM) Goa is not your own. It is of the people, by the people and for the people, and it will remain so forever. So step down immediately. Let Goa live in Peace. Jai Mulnivasi! ***************************************************************************** Green Tribunal has raised important doubts about EC and CRZ clearances to Tiracol Golf Course project 28 May, 2015, 01:20AM IST TEAM HERALD Legal challenge of EC and CRZ clearance for Golf Course project pending; Mandrem village is a turtle nesting site, fact cannot be overlooked, says NGT; project could be category A and EC from MoEF could be necessary PANJIM: While proceedings in the National Green Tribunal, including an appeal challenging the grant of CRZ clearance to the Tiracol Golf Course project, have been stayed, the two fundamentals- The Environment Clearance and the CRZ clearance have been strongly questioned by the NGT, which devolves its powers directly from the Supreme Court. Environmental Clearance: The NGT raised serious concerns while adjudicating on an application of one Sunil Shetye on April 16 that the Tiracol Golf Course and villa project is in blatant violation of all environmental norms. Shetye’s pleas stated that the location of said hotel is within 10 kms from common boundary of Goa and State of Maharashtra and as such it is not permissible under the environmental law. Therefore, the establishment of such hotel is not permissible under the environmental law. It is important to note that the NGT did not give a final order, and asked the applicant to look for a “remedy” once the CRZ permission was given to Leading Hotels and then come back to it. While relief has been given to Shetye, the observations, which reflect clearly in the order of April 16. Here are NGT’s observations: “It appears that, the village Mandrem is declared as place of turtle nesting in the CRZ notification 2011 and therefore, it is not a question, which could be overlooked by the National Green Tribunal, only because Wildlife (Protection) Act, is not covered under Seven (7) Enactments scheduled in the NGT Act. The CRZ notification is covered under the Environment (Protection) Act, 1986, and as such location of village Mandrem as shown in the said notification will have to be taken in to account. The concerned authorities have not disputed the fact that village Mandrem is within 10 km of the project area. Therefore, prima-facie the project could be said as project of category “A” at the time of appraisal and as such EC of MoEF might have been necessary. CRZ clearance issue: The NGT in its April 16 order observed that even if was assumed that even if the EC granted for the Tiracol Golf Course and Villa Project by the Goa State Environment Impact Assessment Authority (GSEIAA) was right, the EC mandated CRZ clearance before it could be treated as operative. “The impugned EC could not be treated as legal and valid, unless the condition appended to the EC could be shown as complied with.” It is clear that the CRZ clearance was needed before the EC clearance was decided. Leading Hotels’ own admission, in a two-page advertisement released in two other English dailies of Goa on Wednesday, which is full of tall claims, contradictions and falsehoods, that can be challenged and dismissed; is that the company obtained the EC from the SEIAA “and separately and subsequently”, the CRZ clearance from MoEF. Thus it is evident at the time when the EC was decided the CRZ clearance was not with the company. The grant of the CRZ clearance has also been challenged by the Goa Foundation and three others and NGT on May 2 rejected a plea by Leading Hotels to dismiss the Goa Foundation & others appeal. The Tribunal rejected the allegations of Leading Hotels against Goa Foundation of mala fide intentions, stating that the appeal is filed to protect the environment. The next legal battle will be fought, briefly in the High Court where Leading Hotels has gone in an attempt to quash the orders along with the proceedings in the NGT. This will also determine and settle the issue whether the High Court has authority to adjudicate on NGT matters. But once the issue of jurisdiction and authority is settled, the legality of the Environmental Clearance and the CRZ clearance obtained by Leading Hotels will be decided.
