People should first wage war with the municipality for allowing the builders to
build without proper plan. I had bought a flat in Mapuca .I do not like to name
the builder for I am ashamed to take his name. Each flat owner at the time of
booking the flat was given a different plan. In the plan the lower portion was
shown as parking on stilts where as the actual building was modified according
to the wishes of the builder.People are not aware that each building should
have what is known as FAR. and accordingly 20% of space should be left out
around the building or may be stilts. 98% of the builders convert the open
space or stilts into godowns or shops which are illegal. We filed a case
against the builder in the consumers forum and won the case. The builder had to
give us compensation as well as 2000 sq metre of land. We formed the society
and the entire land was tranfered to the society and that is what is known as
convenyence. Unless and until this is done by the flat owne
r the land on which the building is built is not yours and at one time when
the building comes down the owner of the property can take back his land. 98%
of the buildings in Mapuca , the society is not formed and also the convenyance
is not done. Those who have bought flats built by the church there is no sale
deed as the church cannot sell the land, and so an agreement is done for
leasing the flat for 99 years. This is worse. I would like the readers to
comment on this.
