Press Statement for Kind favour of Publication - Re: International
Arbitration Centre-Goa.
The news that the Goa Law Commission members along with another 'anonymous'
individual from Delhi have banded together to form a (private) Trust in
order to attract International Arbitration Proceedings is unwelcome news
indeed, firstly because the three members of the Goa Law Commission, two of
which are practicing advocates, are expected to utilize all their spare
time to do the work for which they have been appointed to the Commission.
However, so far, not much has been seen or read by the public with respect
to any legal output from this Commission, and secondly, it is unseemly for
the three members to form such a (private) Trust whilst they continue to be
members of the Goa Law Commission, as the very name of the Goa Law
Commission stands to be sullied by accusations that may emanate from any
quarter and rightly so, that the Goa Law Commission members are making use
of their High Positions. One would have expected that such senior
professionals would have shown more maturity, as DECORUM is also one of the
aspects that the Goa Law Commission members are expected to safeguard.
The invitation sent out for the inauguration of the above International
Arbitration Center at Goa on the 4th of January, 2011, a copy of which this
Party has obtained, imply that this (private) Trust has the backing of the
Goa Law Commission, the Goa Government and the Goa Chamber for Commerce and
Industry [GCCI]. The use by the Goa Law Commission members of the name of
the Law Commission in the formation of this (private) Trust is CONDEMNED by
this PARTY in no uncertain terms. This Party, in fact, wishes to go further
and state categorically that the Goa Government should forthwith publicly
disassociate itself from this (private) Trust and thereafter dissolve the
Goa Law Commission itself, as it has become very clear that the members of
the Goa Law Commission whose stated expenses from 6/4/2009 to 26/11/2010
has been indicated to be approximately 42 Lac rupees, far from justifying
their appointment, are making use of the Law Commission to further their
own personal agenda. Even otherwise, the Chairperson of the Goa Law
Commission, Advocate Ramakant Khalap, apart from owning a dubious
background, is also a party member of the Congress Party and therefore
seems to have been appointed to the Goa Law Commission in violation of the
norms/principles governing such august bodies. This is apart from the
competency of the current Chairperson even to belong to such a Commission as
a member thereof , leave alone as its Chairperson.
