Please permit me to congratulate Soter on his succint analyses of the
"fashionable" and "scheming" set of people who constantly are at work trying to
pull wool over the eyes of the common citizen by keeping the attention and
valencies of the common citizen focussed on the PIE in the SKY which they
promise will accrue to them BY & BY, if they only could have a LOKPAL BILL/ACT.
Lets take a recent case in point ,from our own Amche Bangaranchem Goem. Here is
a Police Inspector who prepares a false report and allegledly tries to cover up
a suspected Murder as Accidental death. A Police Officer who omits relevant
facts. Remember an offence can not only committed by commission but also by
ommission.Whats the remedy? Does it lie in the new hyper-fngled Lokpal Bill or
does the remedy lie closer at hand? Is it sufficient to demand administrative
action of dismissal against the Police Inspector or should not the criminal
law under the Indian Penal Code(*IPC) & Criminal Procedure Code (CrPc) be
invoked?
A number of citizens and community leaders ar blithely unaware of citizen
rights and the duties of citizens.
AS ANY LAWYER WORTH HIS BLACK ROBE PRACTISING CRIMINAL LAW WOULD TELL US THAT
THERE EXISTS PROVISION IN THE IPC WHEREIN A GOVT. SERVANT PREPARING A FALSE
DOCUMENT CAN BE PUNISHED FOR THE CRIMINAL OFFENCE OF PREPARING A FALSE
DOCUMENT. The punisment could be seven years rigourous extending to life
imprisonment!!!!!!!! Indeed the concerned Police Inspector must not only be
dealt with administratively but must also be prosecuted under the criminal law
of our country India, that is Bharat.
On a personal note, some years ago, I had occassion to remind a Director of
Revenue and Land Records of this salutary provision in the Indian Penal Code ,
when he perhaps at the behest of a scheming North Goa lawyer politicio,(who is
now out in the cold) provided me with a document showing the ARABIAN SEA in the
West, as CHHAPORA RIVER!!!! (to circumvent CRZ provisions) I told him that even
my kids know that the Arabian Sea is along the West coast of Goa/India, and
that I would seek his prosecution under the aforementioned provision of the
IPC. To his credit , the clown Govt. Officer/Director started grovelling,
apologised and corrected the "unintentional error"
The answer my friends does not lie in passing new legislation at the drop of a
hat, but in implementing and enforcing existing law which is the congealed WILL
of THE CITIZENS OF INDIA.
As the Mahatma said " LET US BE THE CHANGE WE WISH TO SEE IN THE WORLD"
