Well, you have a number of things going on here. As to your question, I would think that, as long as you are abundantly clear that the user is not paying for translation features, you should be okay. HOWEVER - and make sure to read this - I would also point out that the TOS prohibit the development of a site where the translation results comprise the primary content of the site. This would seem to me to preclude the entire concept of your service. I am not, however, a legal expert. I would strongly advise you to consult someone who is.
