One way of looking at the question is: I have a map available for free. I'm also making that same map available to paying customers (for ease of use in the paid section of the site). Is that a violation? I don't believe it is. There's an FAQ which is vaguely relevant, http://code.google.com/apis/maps/faq.html#tos_password -- that suggests that you might pay for admin access to the map and still remain within the TOU (I think); so simply duplicating a free map within the paid section of a site should be ok.
