I'm not quite sure what you are referring to as a 'static' map. If you
are referring to an image taken from a screen shot, then that IS a
violation of the TOS.

However, there is nothing stopping you using a static map as generated
dynamically by the Static Map API:
 http://code.google.com/apis/maps/documentation/staticmaps/
(as long as the other conditions in the TOS are observed)

Be aware that, if you are embedding the static map image in a clients
page, then the API key on the image GET URL must be one for the client
page domain.
