The TOS are all about Google's code and services, not yours. You can do what you like with your own code and services, which would essentially be a sort of WMS wouldn't it? As you already noted, it's when the map is deployed that Googles TOS apply. Warning ; if you host your customers maps and they do 'bad things' its your key that gets blocked.
