Don't forget that the Terms of Service require that Static Maps can
only be used in a browser. A dedicated desktop app *probably* doesn't
count because the user doesn't generally have the opportunity to enter
their own choice of URL, follow links and the like.

As you say, a desktop app can use the Javascript API if it's capable
of running it and it's freely available to anyone.
