Excellent catch! How in the world did you work that one out?
It looks like it may indeed be an API bug, but after a quick glance at
http://code.google.com/p/gmaps-api-issues/ I didn't see it.

I've updated my article, 
http://lab.gmtplusone.com/google-maps/polyline-click-issue/,
to include a switch that takes you back and forth between the current
v2 and the v2.149 and allows for switching on and off the two polyline
listeners. Although I just noticed that while viewing the app in IE8
its jerky and doesn't respond well ... could be because I'm using
Parallels or the switch I put in place isn't working well in IE8 ...
in any case would love to see your final app and I'm glad you were
able to find a solution that works for IE8 in its native mode as
well ; )
