Depends on the cellphone. If it's an iPhone, then that is allowed by
the iPhone Terms of Service: http://code.google.com/apis/maps/iphone/terms.html
(see 9.1) but these Terms only apply to the iPhone and its SDK.

If it's not an iPhone, then the standard terms apply
http://code.google.com/apis/maps/terms.html and charging for an app
which includes mapping is not allowed, even if a free version is also
available. Marcelo's answer is a good solution.
