This is absolutely forbidden by the Terms. 10.1 means you can only
access the Content (which includes the imagery) using the API; 10.2
specifically forbids making a derivative work. 9.3(b) covers allowing
others to break the Terms: by using your site they are also agreeing
to them.

So what follows is rather moot.

No. You may be able to get Google to vary the Terms to allow
derivative works, but they won't do that without a Premier licence
payment up-front (if then). And it may be *far* more than $10k.

Note: you can make money off advertising on your site (eg Adwords),
and you can make money by charging to display third-party data on your
map, as Rossko indicated in the FAQ.
