There are two licences: free and Premier. The Terms are the terms. While there is some dispensation for use in a development environment, that's a relaxation of the Terms which is not explicitly stated. It's been taken to mean "development of a public-facing site". I'm sure that's been confirmed by Thor or Pamela in the past, although Google are usually careful not to state anything which is not already in the Terms. I am sure that development of something which will never be published will need a Premier licence, because you start out with the intention of not complying with Term 9.1.
