You didn't give a link to any map demonstrating a problem.

I can look at the KML http://www.mario-baldauf.org/test.kml and see
that the Icon image used has a small red dot at the bottom of a 32x32
pixel mostly transparent field.
The infowindow "beak" anchors to the top corner of the whole icon,
some distance away from the visible dot.  Whatever level you zoom to,
the beak remains a fixed screen distance from the red dot, which
appears like different distances on the map.

That's not a Maps API bug.
