It would be on a Free licence. The Enterprise terms allow some leeway to negotiate what you want -- for an appropriate fee. Since http://www.google.com/enterprise/earthmaps/earth_enterprise.html does say "Your sensitive data remains secure. Create custom Google Maps and Google Earth 3D Globes and limit use to only those within your own department.
