I guess the theme maker should not have the publish option until it can pick the current user's theme xmls. It could be done like gadget editor works - by saving an xml in the user's gmodule directory.
I have three similar themes two created by the theme maker and approved in 2 days and one created in the xml from a scratch and still not published. I'd like to delete the trash created by the theme maker but I guess there is no way for that now. I guess it should be hi-priority enhansment request for theme api developers to provide a way to delete a theme.
