Only possible if the owner of that server is prosecutable in Australia. As long as I am an Australian resident, I would be prosecutable. However, if I transfer ownership to for example my sister who lives in Germany, she is not prosecutable and australian authorities can do bugger all as long as the content would not violate german law at the same time.
