Surat: In a major blow to police, a local court here on Saturday granted
bail to Sulat Puwar, who was arrested from the Dang district on March 28 on
the charge of being involved in Naxal activities in Gujarat.
Puwar, who has been in judicial custody since April 3, had applied for bail
in the district and sessions court.
The court said in its order that the police could not provide evidence to
establish that Puwar was associated with Naxal activities. Puwar was
released on a bail of Rs 5,000 and has been asked not to leave Gujarat. He
has also been asked to surrender his passport.
Police in its chargesheet had said that Puwar was an active member of
Communist Party of India (Marxist-Leninist) Janashakti. He was charged under
various sections like sedition, criminal conspiracy and promoting enmity
between different groups.
Defence lawyer said Janashakti was not a banned organisation. Therefore,
being its member was not a crime. He also argued there was no evidence with
the police to establish that Puwar was ever in touch with any of the
accused, who are under arrest on similar charges. The defence lawyer argued
that Puwar was involved in tribal welfare activities.
The prosecution’s strongest allegation was that Puwar had received training
in arms handling in Kerala from a Philippines trainer.
However, police could not provide any evidence in this connection apart from
the statements of co-accused in which they had confessed of having taken
arms training.
