(deceased), son of Fayej Sk., aged about-22 years, by faith-Muslim, resided at village-Budhurpara, Police Station-Raninagar, District-Murshidabad, West Bengal, India; (2) Sentu Sk(deceased), son of Abdul Mannan, aged about 27 years, by faith-Muslim, resided at Dakshin Char Majher Diar, Police Station-Raninagar, District-Murshidabad, West Bengal, India *Name of the Perpetrators**: -* The on-duty Border Security Force jawans posted on 28.12.2010 at Out-Post no-IV under Kaharpara BSF Camp, Company-B, Batallion-52, Police Station-Raninagar, District-Murshidabad. *Time and Date of incident**: -* On 28.12.2010 in between 4.30 to 5 am. *Place of incident**: -* Near the BSF Out-Post no. IV under Kaharpara BSF Camp, Police Station-Raninagar, District-Murshidabad *Case Details**:- * On 28.12.2010 from 3.30 am onwards some smugglers tried to smuggle cattle to Bangladesh near the BSF Out-Post no.-IV. It is revealed during our fact that the victim was present there with the smugglers. The on-duty BSF jawans of the said BSF Out-Post soon apprehended the victim, Miltan Sk. and another person Mr. Sentu Sk. It is reported that the BSF jawans fired Miltan Sk. bullet on the chin and the bullet exited from his head. The BSF jawans also fired bullet on the left side of the chin of Sentu Sk and the bullet exited from his right ear. The police of Raninagar Police Station was informed by the said BSF jawans. The Officer-in-Charge of Raninagar Police Station arrived there and took the body of both Miltan Sk. and Sentu Sk. to Godhanpara Primary Health Centre in a BSF van being no WB-51/9243 where they were declared dead. Mr. Bishnupada Nath, Executive Magistrate & Sub-Divisional Police Officer, Domkal held the inquest on the body of Miltan Sk. and Sentu Sk. at the said hospital on 28.12.2010 at about 11 am. The police of Raninagar Police Station registered one unnatural death case vide Raninagar Police Station U.D. Case no.29/2010 in the matter of the death of Miltan Sk. and Sentu Sk and their post mortem examination was held at Lalbagh Sub-Divisional Hospital, Murshidabad. On 29.12.2010 Mr. Bajlur Rahman brother of Sentu Sk lodged written complaint before the Officer-in-Charge of Raninagar Police Station that his brother Sentu Sk and another victim Miltan Sk was murdered by BSF without any justification. The police treated the complaint as First Information Report being Raninagar Police Station case no. 705/2010 under section 302(punishment for murder) of Indian Penal Code. It is also revealed during fact finding that Mr. Amba Dutta, Company Commander, BSF also lodged one written complaint at Raninagar Police Station on the same incident to the effect that Miltan Sk. and Sentu Sk. both died as a result of encounter. The police investigation is still pending in the said case and accused persons are still at large. No attempt was made to arrest the accused BSF personnel nor the investigating officer visited and / or collected the statements of the victim family members or the witnesses.
