Well spotted Peter, :-) Had not noticed that. Looks like this is more of a Snow Leopard bug perhaps then.
This bug doesn't happen all the time, it is intermittent. So going to take some troubleshooting I guess from me. To narrow it down. I double click on the menu, otherwise the menu refuses to "fix itself" There isn't really a set way I can get the menu to function properly again. That was just one example. However I will try what you suggested. The menu bar is also very slow to load when this bug happens.
