Panaji June 26, 2005: The 30-day stay period granted by the Goa bench of the Bombay High Court to two Bharatiya Janata Party MLAs, Mr Dayanand Mandrekar (Siolim) and Mr Rajendra Arlekar (Vasco da Gama), on its judgment which set aside the election in the two constituencies of Siolim and Vasco da Gama, by declaring it as null and void on the ground that both these MLAs were holding the office of Profit under the state government during the time of the May 2002 assembly polls, ends on June 27.
The HC had granted the stay to the respondents on their request for enabling them to appeal before the Supreme Court. At the same time, the HC had given liberty to petitioners, Mr Chandrakant Chodankar and Mr Jose Philip DSouza, to apply afresh to the High Court for modification of the order, if permissible under law, in case the Presidents rule then imposed on Goa under Article 356 of the Constitution gets revoked.
The petitioners had appealed in the SC against the HC judgment, earlier this month.
The summer vacation of the Supreme Court extends up to the month of July and as such special sittings of the apex court are held every Monday, during this period. Therefore the SC is expected to call the first hearing on the appeal, tomorrow.
