I know this has been talked about alot, but I wanted to paste the wording of the law.
GENERAL ASSEMBLY OF NORTH CAROLINA SESSION 2009 H 1 HOUSE BILL 1686 Short Title: Bicycle Safety Changes. (Public) Sponsors: Representatives Cole; Hughes, Neumann, and Whilden. May 13, 2010 *H1686-v-1* 1 A BILL TO BE ENTITLED 2 AN ACT TO ENSURE THE SAFE OPERATION OF BICYCLES BEING OPERATED IN 3 GROUPS OF TWO OR MORE ON THE STATE'S STREETS AND HIGHWAYS, AS 4 RECOMMENDED BY THE JOINT LEGISLATIVE TRANSPORTATION OVERSIGHT 5 COMMITTEE. 6 The General Assembly of North Carolina enacts: 7 SECTION 1. Chapter 20 of the General Statutes is amended by adding a new 8 section to read: 9 "§ 20-171.3. Operation of bicycles on streets and highways. 10 Bicyclists riding bicycles upon a street or highway shall not ride more than two abreast, 11 except on paths or parts of roadways set aside for the exclusive use of bicycles. Persons riding 12 two abreast shall not impede the normal and reasonable movement of traffic and, on a laned 13 roadway, shall ride within a single lane. Persons riding two abreast shall move into a single file 14 formation as quickly as is practicable when being overtaken from the rear by a faster moving 15 vehicle." 16 SECTION 2. This act becomes effective December 1, 2010, and applies to 17 offenses committed on or after that date. One question for any of our lawyers in the group - when the law states that 'Persons riding two abreast shall move into a single fil formation as quikcly as is practibcable when being overtaken from the rear by a faster moving vehicle.", does that put the 2 abreast cyclists at fault when a car has a brush up passing a double line? I want to be practical and respectful and ride reasonably so cars can pass when it is safe to do so, but it seems that some liability may be moving from the passing motorist to the cyclist.
