Anwar vs Mahathir - RM100 mil suit ‘still on’ - Arfa’eza A Aziz -
One-time deputy premier Anwar Ibrahim has not wavered in his intention to file a RM100 million defamation suit against his former mentor Dr Mahathir Mohamad.
“Dr Mahathir can be sure that a writ of summons is certainly coming his way,” his lawyer Sankara Nair (left) told a press conference at the Sultan Abdul Samad building this morning.

He expects the suit to be filed within two weeks when Anwar will return for a short break from his lecturing stints in United States and the UK.

On Sept 20, Anwar said he would take legal action against Mahathir if the latter refused to apologise and pay RM100 million in compensation for statements alleging that he (Anwar) is a ‘sodomist’.
Mahathir rejected the demands and said he would “vigorously defend” any proceeding against him. There have been no new developments since.
Anwar had described Mahathir’s remarks as “grossly negligent, reckless, irresponsible, deliberate and malicious”. He further claimed that the remarks were aimed to discredit his character and “expose him to public hatred, scorn, odium, contempt and ridicule”.
Sankara explained that the delay in filing the suit was due to the meticulous gathering of evidence and preparation of documents.

“This is a serious and complex matter. I have to be circumspect and have been meticulously gathering the evidence and preparing the pleadings in consultation with several senior counsel including Raja Aziz Addruse and Datuk Param Cumarasuamy,” he said.

He said that he has been in “constant contact” with Anwar to discuss the legal action.

Confident of success

Sankara also said he is aware that Mahathir has been repeating the allegation.

“We have confidence (that we will succeed), no matter what Dr Mahathir says,” he said.

Anwar, once the heir apparent to Mahathir, was sacked in 1998 and subsequently charged and convicted for sodomy and corruption.

He was sentenced to 15 years’ in jail for both offences, and completed the six-year sentence for corruption. Last year, the sodomy conviction was quashed upon appeal to the Federal Court and he was freed.
From the onset, Anwar has claimed that the charges were trumped-up as there was a political conspiracy against him. However, Mahathir has denied this.
 
Dr M in the limelight at summit -
Former premier Mahathir Mohamad is revelling in the spotlight as the region's leaders come to town, proving old habits die hard after two decades on the international stage.

Although officially retired since 2003, the irrepressible 80-year-old has grabbed attention by accusing Australia of crashing the party and launching a tirade against his former protege Anwar Ibrahim.

Mahathir, who shaped modern Malaysia during his long term in power and remains a high-profile figure on the political scene, first conceived of the summit, which holds its inaugural gathering on Wednesday.

But much to his chagrin, what was intended as a "caucus without caucasians" has now come to include Australia and New Zealand - as a counterweight to China in the absence of the United States.

"Now, Australia is basically European and it has made clear to the rest of the world that it is the deputy sheriff for America," Mahathir said acidly last week.

"I am afraid that, knowing Asians, who are always very polite and do not like to appear to be recalcitrant, the views of Australia are likely to dominate," he said.

His jab at Australia, whose then-premier Paul Keating dubbed him "recalcitrant" for refusing to attend a 1993 regional summit, apparently hit the mark.

Australia's Foreign Minister Alexander Downer on Saturday lashed out at a reporter who relayed the suggestion that his country would act as a proxy for America in a new 16-nation bloc.

"I think even you could move beyond the puerile allegations of a 'deputy sheriff,'" he snapped at a reporter.

It was left to Foreign Minister Syed Hamid Albar to defend Canberra's presence, saying the summit had moved beyond a geographical definition that would have excluded Australia.

Mahathir handed over to current Prime Minister Abdullah Ahmad Badawi two years ago, but the new administration is still trying to step out of the shadow of the long-time leader who remains one of Asia's best-known political figures.
New broadside against Anwar

He held court again over the weekend, issuing a new broadside against his one-time deputy Anwar, who was sacked in 1998 and jailed on corruption and sodomy charges.

Anwar was freed in September 2004 after six years behind bars, and is now storming back onto Malaysia's political landscape with new leadership ambitions.

But Mahathir maintained on Saturday that although Anwar's sodomy conviction has been overturned, he was still not in the clear and should accept that his political days are over - just like his own.

"The judge said he was involved in homosexual acts but not on that day. He is not fully innocent," he said.

"It is time for younger leaders now. There may be in the future an opportunity for him to make a comeback. But he will be old by then. His chances are very slim."

Mahathir said he hoped that the ruling Umno that has produced every Malaysian prime minister since independence from Britain in 1957 would not take Anwar back.

"I would be sorry if Umno were to agree to his comeback," he said. "(But) Anwar is quite capable of doing things you do not expect of him ... it would not be surprising if he joined Umno."

Once considered an Asian political star, Anwar was famously beaten up by the then-police chief after his arrest, a saga that made world headlines.

The row is still being fought in the courts, and Anwar was this year awarded RM4.5 million in damages over a book that aired the sodomy allegations.
He also won a public apology over the beating as well as undisclosed damages, a result he hailed as a step forward for human rights in the country.

Terjemahan Bekas Timbalan Perdana Menteri, Datuk Seri Anwar Ibrahim tetap akan menfailkan saman malu berjumlah RM100 juta terhadap bekas mentornya, Tun Dr Mahathir Mohamad.

Peguamnya, Sankara Nair (foto) memberitahu sedang akhbar pagi ini bahawa writ saman tersebut pastinya akan sampai ke tangan Dr Mahathir.

Beliau menjangka saman tersebut akan difailkan dalam tempoh dua minggu apabila Anwar pulang bercuti daripada tugasnya di Amerika Syarikat dan United Kingdom.

Pada 20 September, Anwar berkata, beliau akan mengambil tindakan undang-undang terhadap Dr Mahathir jika bekas Perdana Menteri itu enggan memohon maaf dan menuntut gantirugi RM100 juta kerana didakwa membuat kenyataan Anwar seorang ‘peliwat’.

Dr Mahathir menolak tuntutan tersebut dan berkata belaiu akan mempertahankan prosiding memfitnah yang dibawa terhadapnya.

Anwar antara lain, mendakwa, Dr Mahathir telah dengan sengaja, tidak bertanggungjawab dan berniat jahat ketika membuat kenyataan tersebut.

Katanya lagi, kenyataan Dr Mahathir itu dibuat dengan tujuan untuk mencemarkan dirinya dan mendedahkan dirinya kepada kebencian umum.

Sankara menjelaskan bahawa kelewatan memfailkan saman tersebut adalah disebabkan masa yang diperlukan untuk mengumpul bukti dan menyediakan dokumen terbabit.

Katanya, ia merupakan satu perkara yang serius, kompleks dan beliau perlu teliti dan berhati-hati di samping mendapatkan pandangan beberapa peguam kanan, termasuk Raja Aziz Addruse dan Datuk Param Cumarasuamy.

Menurutnya, beliau sentiasa berhubungan dengan Anwar berhubung tindakan undang-undang itu.

Yakin berjaya

Sankara berkata, beliau juga menyedari yang Mahathir telah mengulangi dakwaan tersebut.

“Kami yakin (yang kami akan berjaya), tidak kira apa Dr Mahathir kata,” katanya.

Anwar dipecat daripada kerajaan dan Umno pada 1998 dan kemudianya didakwa di mahkamah dan disabitkan dengan kesalahan meliwat dan salahguna kuasa.

Beliau dihukum 15 tahun penjara bagi kedua-dua kesalahan tersebut, dan telah selesai menjalani hukuman enam tahun penjara bagi kesalahan salahguna kuasa.

Tahun lalu, Anwar dibebaskan apabila Mahkamah Persekutuan menerima rayuannya dan membatalkan tuduhan serta sabitan kesalahan liwat terhadapnya.

Dari awal lagi, Anwar mendakwa tuduhan terhadapnya itu sengaja direka-reka dan merupakan konspirasi politik untuk menjatuhkannya. Dr Mahathir bagaimanapun, menafikannya.
