Not split hairs too much, but copyright law the U.S. begins in 1927. (I was in a session with the Michigan State University copyright lawyers, several years ago.) Anything before that time is not protected by U.S. Copyright, so far as I undersand that law. Of course, the Online Computer Library Center can copyright its product. I am not a lawyer (and do not play one on television). We need a legal opinion by copyright experts before proceeding further." Having followed the discussion on Autocat about this, I can tell you that the it is trademark infringement at the heart of the lawsuit, not copyright. I am not a lawyer either, but according to reports, it is up to the 'owner' of the trademark to actively defend its ownership, or they will lose it. I am not a big fan of the way OCLC conducts their "non-profit" business (going back to their copyrighting of the database of shared records), but they claim that they made repeated requests to the hotel to acknowledge the trademark and the hotel refused.
