End-user license agreements generally (read: always) specifically state that
the publishers are to be held harmless in the event that their product
causes problems.

Fact is, each computer is generally unique in terms of hardware, software
and configuration. It's impossible for a software publisher to guarantee
there won't be a conflict under every possible scenario or permutation. Your
experience is certainly an extreme, but you have little recourse in the
matter. Fact is, the vast majority don't experience any problems whatsoever.
The fact that you did would indicate to me that you had a ticking timebomb
of sorts on your machine, either from some sort of misconfiguration or
corruption. If Diablo didn't trigger the problem, my guess is that something
else eventually would have anyway.

While it's easy to blame Blizzard or Microsoft, it would be folly to point a
finger at either and state unequivocally that it is their fault. These
things unfortunately happen. It's the nature of the industry. Your
experience is why God invented back-ups.
