Doh! I managed to misinterpret the entire crux of the original post. I
skimmed and assumed 'exploded' was referring to a subsequent loss of
stability in the operating system. This is what I get for not consuming
mass-quantities of coffee in the morning. Obviously my 'backup',
'misconfigurtion' and sundry other comments don't apply, given that we're
talking about a physical failure of the media and subsequent damage to the
CD.

However, I'd imagine the EULA firmly applies to this as well. If I were you
I'd go after the drive manufacturer too, though I imagine it will just point
its fat, capitalist, blood-of-the-worker soaked finger at the media.
