There are a number of plugins written that change the server response as it's not that hard to do.
I might be wrong, but I believe that the SourceOP plugin actually uses the 33rd slot as a reserve slot and does some fancy hacks to kick a player and transfer the 33rd person to their slot when they are connected. As Nephyrin said, there isn't a lot that can be done about it without causing other problems.
