permissions and ownership on that file are correct (ive just chowned and
chmodded recursively again)  I don't think its a DoD issue as such if its
running fine as root.  I can only think that it must be some kind of
permission based error outside of the hlds_l folder?

Did root by chance do the file replacing? Have you checked permissions on
the file? If it runs fine as root that would be the place I'd look.
