Are you certain that there wasn't a typo involved in the case where ordering changed the results? Also, are you certain that the queries were of the same type (e.g. the terms were OR'd in both queries, or AND'd in both queries)? In 3.1.6, I am not aware of ordering having any effect on the number of matches.
