We run 3.1.6 on solaris 8 and 9. I've never seen this error. htmerge may fail because sort is running out of disk space. Do you have enough disk space in /var/tmp for a large sort? If not, tell sort to use another directory on a partition with lots of free space. Setting TMPDIR environment variable will cause htmerge to pass this to sort correctly as -T option.
