The Resolution of the Pune Bar Association seeking to deny professional legal
assistance to those arrested allegedly for the bomb blasts at the Pune Bakery
is illegal and unconstitutional, apart from being discriminatory, as earlier
no such resolution was passed to deny legal assistance following Shaheed
Hemant Karkare's investigation exposing saffron terrorists on whom flowers were
showered in court rooms similarly no such legal assistance has been denied to
well known members of the underworld among others and those charged with the
assassination of a former Prime Minister .The most eminent lawyers have been
available to the latter category .
This Resolution among other threats and intimidation to lawyers in
other parts of the country including in Mumbai and the assassination of
advocate Shahid Azmi even as the Home Minister of the country is a former
eminent lawyer . exposes the state of the legal profession and justice system
. Apart from the fact that no trial conducted under such intimidation can ever
be considered to be a fair trial .
Serious issues arise from the threat to lawyers , the criminal intimidation
to which they have been subject while performing their professional duty , the
assassination of Police officials for sensitive investigations, attempts to
murder lawyers and the assassination of lawyer Shahid Azmi who assisted
those falsely charged by members of the underworld and hired killers, who were
given the compliment of being " patriotic ".
When the Rule of Law and Democracy is seriously undermined, hired killers are
called " patriotic ".
It is necessary for those who have unleashed this terror against lawyers to
reflect . To-morrow it may be those who have unleashed the terror on innocent
people and intimidated lawyers preventing them from performing their duty who
may be at the receiving end .
In a lawless society , ask not who is safe as no one is .Once there is impunity
for hired killers any one is at the receiving end, even political or
commercial rivals .
