That's a z/OS.e restriction not a z8xx one. You can run z/OS on a z8xx and use the compiler there (provided, you've got a license). LE has always been a basic element of z/OS (and one of OS/390 for a long time, at least), so I don't think you can have a z/OS (OS/390) system where LE would not be licensed.
