I believe you're correct on IBM's legal position - up to a point. But when they provided that information previously for development of the software, did they not in effect diminish the strength of their case merely through that action?
I really wish that the USERS (that's us) were able to file an amicus curiae brief so that OUR wishes are heard and rights protected.
