You would be surprised what "gets through". Years ago a software vendor claimed to have patented the use of RBA (Repeat to Buffer Address) in a 3270 controller as one point of their optimization of data streams. Of course, years beyond that, after much wasting of time, contention and heartburn (and only truly enriching the lawyers), they were forced to concede that point from their claim. Even today, in an effort to streamline the process, the government has not placed as much emphasis on inspection and critique. They do not even staff appropriate experts to review applications and claims of "prior art". As a consequence many things sneak in. They may sit for years "pending" but they are at least there for the possible benefit of the claimant.
