This still does not answer the question that was raised about why the system does not keep track of the fact that it has been running and move the date it uses for the TMSINIT check to the last time it updated the TMC. Thus it would only complain if the CPU has been powered off for days (or the TOD clock was reset wrong). So log as I do a scheduled IPL, the date that should be checked against is NOT the prior IPL but the shutdown time (ie: Update the time when you shut down the TMS task) OR the last time any update was done to the TMC (in the case of a Power Failure or non-clean shut-down).
