I'm surprised it's taken this long. But I'm also surprised some-one like
Neon did it; their legal eagles must have had a fun time combing through
all the IBM covenants. It's not like IBM is totally averse to resorting
to the courts. 
When the zIIP first came out with a restricted percentage of eligible
work actually dispatched on the zIIP, it was obvious people would be
looking to "better" use the engine(s). zAAPs and new eligible workloads
made this even more obvious. 
I can't be the only (non-ISV) customer sysprog that has thought "I
wonder how that works - might be handy here". Pity none of us has the
spare time and machinery to have a play.
