Re: “Are there labor laws that require a different outcome?”, the problem as I 
understand it is that the source of data for a “prevailing wage” comparison 
isn’t specified in the existing laws.  If the law had been written to say “. . 
. prevailing wage for the location based on the federal Labor Department report 
blah-blah-blah and its successors” then there could be some enforcement, if 
only by civil suits from American workers if not from local attorneys general.  
With no standard to base “prevailing” on, it’s a giant loophole and easy money 
for predatory businesses.

I'm interested, Shmuel.  What immigration laws aren't being enforced?  I heard 
someone else here post the number of visas being made available; are you saying 
more Indians are getting in than that number allows?



And what labor laws aren't being enforced?  Speaking with my capitalist hat on, 
I suggest that employers ARE paying Indians prevailing rates - for Indians.  
Naturally they're happy with shorter pay than Americans, and naturally that 
reduces somewhat the rate Americans can get for the same services.  Are there 
labor laws that require a different outcome?

The problem isn't the visas themselves, but the lack of enforcement of 
immigration and labor laws. If they actually paid prevailing wages then it 
wouldn't be an issue.
