Yes it is legally valid but impractical to the point of being
impossible. If someone does get a stall in his/her own name he/she
immediately becomes personally liable for Rs.25,000 or Rs.35,000 from
his/her own pocket.
Also, when approaching sponsors, how do we represent ourselves if we
have no formal existance? If we do find willing sponsors, in whose name
do we finally get the check written? the individual who books the stall?
the owner of ILUG-CAL? any odd member? Would any reasonable sponsor go
ahead with writting checks to individuals? How do they show it in their
books for tax purposes?
To do anything that involves money, i.e. to do anything in the real
world, we need to have a bank account in the name of the organization.
As I said before, one first needs to EXIST in the real world before one
can DO anything in it.
Moreover, ILUG-CAL.org - the URL - remains the private property of an
individual - this means any efforts by the volunteers could, at least in
theory, later be usurped by the owner for personal gain. Of course,
this is a hypothetical statement - the list owner has never indicated
any such intention. Nonetheless, it is a valid argument for formalization.
On the other hand, the Lugers, except for a three, have not responded,
thereby indicating their lack of interest in formalisation as a Society.
There seems to have been enough interest to volunteer. Experienced
individuals, who have done this kind of thing before have stated that
sponsorship would be possible. There are individuals who are willing to
shoulder the responsibilities of all the logistic hassles. The only
thing missing is a legal entity in whose name we can move ahead.
I shall wait till this meeting - if it does come about - to see if we
have the will and the sense to do the right thing. We need atleast 7
individuals who are willing to meet at regular intervals - how often can
be decided by the group.
