well, fact is the GPL was drawn up mainly by RMS. but i see your point.
trying to make changes.

the GPL says the distributor must either make the source available, or
supply a written offer to make it available in machine-readable format,
on a medium customarily used for transferring computer data. that means
the initiative must first come from the giver, not the taker. we could
add "unless the customer forfeits the right", but that would be
cumbersome.
