It also depends on the Register.  I use Wild West, Bulkregister and Enom.  Wild West and BulkRegister release the names to the open market.  Enom, on the other hand, KEEPS THE DOMAIN and holds it for Ransom in Afternic.  I like Enom... but their keeping of the domains is just wrong.  I use to have over 300 domains registered with them, but since they started doing this... Here is my "opinion" as is free.... First of all, it takes about 2-3 months after a domain expires before another party can buy it, so this site would have been offline for about three months. There are several statuses it goes through like pending delete etc. If the domain was not hijacked, you are up creek without a paddle, unless you can litigate the name is a violation of a trademark.
