It also depends on the Register.  I use Wild West, Bulkregister and Enom.  Wild West and BulkRegister release the names to the open market.  Enom, on the other hand, KEEPS THE DOMAIN and holds it for Ransom in Afternic.  I like Enom... but their keeping of the domains is just wrong.  I use to have over 300 domains registered with them, but since they started doing this... I have moved all but 25 away from them.

Here is my "opinion" as is free.... First of all, it takes about 2-3 months after a domain expires before another party can buy it, so this site would have been offline for about three months. There are several statuses it goes through like pending delete etc. If the domain was not hijacked, you are up creek without a paddle, unless you can litigate the name is a violation of a trademark. Not an attorney, nor are most people on here, so you may need to contact one if you are looking for legal advise.
 
If it were me, I would get about a 1500.00 budget and try to by it back and make sure you use a domain name escrow service.

Hello All,

Im calling on the experience in this group for some advice. I have a client whose domain name expired over the weekend and we never got a notification due to a partnership split and email address change (long story).

Anyway, the domain name has already been registered with another company and Im now trying to get it back. Can anyone suggest a strategy on how to approach this?
