I don't think it is negligent. This is a relatively new exploit found very recently and Imail have released a fix quite quickly.
I take the view that if you use outdated software without an SA then you are leaving yourself vulnerable and you have to be at least partially responsible for what follows - it is your implementation. Pressure Ipswitch to bring out a fix for previous veriosn by all means, I think they should but don't expect them to do so.
