I personally like the HABEAS idea but I doubt in practice it will work well. They say the will be prosecuting on trademark and patent basis. while this is fine in the US it is really hard to do across international lines. So, prosecuting someone in the states would probably work but, most of the spammers come from outside the US and the laws are different. It's a step and shows someone is always thinking.
