It's up to the server. UW imapd has never intentionally allowed
deleting the currently-selected mailbox.
imapd 2006c can still delete a currently-selected mbx mailbox, though -
but that's not "intentionally", I assume. :-)
A related topic is RFC 2180, section 3. Think of the case of deleting
the selected mailbox as a special case of this one.
