(Reuters Photo/Suzanne Plunkett) President Susilo Bambang Yudhoyono announced on Wednesday that the Constitutional Court ruling on the dissolution of oil and gas regulator BPMigas would not harm any existing contracts in the country’s oil and gas sector. The president commented that BPMigas would not technically be dissolved, as he had signed a presidential regulation specifying that the body, formerly independent, would now be under the jurisdiction of the Energy and Mineral Resources Ministry. “The presidential regulation that I’ve issued basically says that the now-defunct BPMigas will [work] under the Energy and Mineral Resources Ministry during this transition period. It will keep performing its functions and duties, and I have ordered the energy and mineral resources minister to conduct an audit... on BPMigas to ensure its transparency,” Yudhoyono told a press conference at the presidential palace in Jakarta on Wednesday. “To local and foreign investors, as well as other actors in the oil and gas sector: all agreements and work contracts remain in place. All work and operational activities, as part of BPMigas’ partnerships with investors and the business sector, will continue as they were,” he added. Former BPMigas chief R. Priyono said shortly after the verdict on Tuesday that the court's decision threatened the legal status of 353 work contracts (worth $70 billion) in the oil and gas sector that have been in place since 2002, when BPMigas was established, according to Indonesian newspaper Investor Daily. Yudhoyono said he expected his statement to clarify the matter and diminish confusion and fears over the legal uncertainties that arose as a consequence of the ruling. The court annulled BPMigas on the basis that the role and responsibility of the organization violated Article 33 of the 1945 Constitution, which states that resources should be controlled by the government. The court approved a request by 42 organizations and individuals, including Muhammadiyah, to review the 2001 Law on BPMigas. Yudhoyono said Indonesia recorded an average of Rp 300 trillion ($31.4 billion) in oil and gas revenues per year, with up to Rp 200 trillion invested in the sector every year. BPMigas was established in 2002 during the presidency of Megawati Soekarnoputri, the president said, to avoid conflicts of interest, since such regulation had been previously handled by state oil and gas firm Pertamina, an industry player. He added that the government would begin the drafting of a new oil and gas law on Thursday to further ensure legal certanties in the sector. [Non-text portions of this message have been removed]
