The American Ghosts of Abu Ghraib : War Criminal
Former Army Sgt. Sam Provance was one of the
heroes of the Abu Ghraib scandal, the only
uniformed military intelligence officer at the
Iraqi prison to testify about the abuses during
the internal Army investigation. When he
recognized that the Pentagon was scapegoating
low-level personnel, he also gave an interview to ABC News.
For refusing to play along with the cover-up,
Provance was punished and pushed out of the U.S.
military. The Pentagon went forward with its plan
to pin the blame for the sadistic treatment of
Iraqi detainees on a handful of poorly trained
MPs, not on the higher-ups who brought the
lessons of alternative interrogation techniques
from the Guatanamo Bay prison to Abu Ghraib.
The Congress, which was then controlled by the
Republicans, promised a fuller investigation.
Provance submitted a sworn statement. But
Congress never followed through, leaving Provance
hanging out to dry. Then, in February 2007, he
went to a special screening of the documentary,
Ghosts of Abu Ghraib, and learned more than he
expected about why the scandal died

FBI turns citizen into a secret informer : Dictatorship
The Justice Department's inspector general
revealed on March 9 that the FBI has been
systematically abusing one of the most
controversial provisions of the USA Patriot Act:
the expanded power to issue "national security
letters." It no doubt surprised most Americans to
learn that between 2003 and 2005, the FBI issued
more than 140,000 specific demands under this
provision -- demands issued without a showing of
probable cause or prior judicial approval -- to
obtain potentially sensitive information about
U.S. citizens and residents. It did not, however, come as any surprise to me.
Three years ago, I received a national security
letter (NSL) in my capacity as the president of a
small Internet access and consulting business.
The letter ordered me to provide sensitive
information about one of my clients. There was no
indication that a judge had reviewed or approved
the letter, and it turned out that none had. The
letter came with a gag provision that prohibited
me from telling anyone, including my client, that
the FBI was seeking this information.

associates were convicted of white-collar crime
and sanctions violation. Indeed, at the time of
Aschcroft¹s resignation there was only one bona
fide terrorism conviction, that of the shoe-bomber Richard Reid.

Report: Some Unjustly Labeled Terrorists
SAN FRANCISCO Businesses checking customers'
names against a Treasury Department terrorist
watch list are sometimes denying services to
innocent people, according to a report released
Tuesday by civil rights lawyers.
The 250-page list, posted publicly on a Treasury
Department Web site, is being used by credit
bureaus, health insurers and car dealerships, as
well as employers and landlords, according to the
Lawyers Committee for Civil Rights of the San Francisco Bay Area.
The list includes some of the world's most common
names, such as Gonzalez, Lopez, Ali, Hussein,
Abdul, Lucas and Gibson, and companies are often
unsure how to root out mismatches. Some turn
consumers away rather than risk penalties of up
to $10 million and 30 years in prison for doing
business with someone on the list, the group said.

The Pentagons Power to Jail Americans Indefinitely : Dictatorship
Padilla had filed a motion to dismiss the case on
the ground that the federal government had denied
him his right to a speedy trial. Padilla has been
in custody since May 2002 and his trial, which is
scheduled to begin in April, is not being held until some five years later.
From May 2002 until January 2006, Padilla was
held in U.S. military custody as an enemy
combatant in the war on terror. In January
2006, the Pentagon chose to transfer custody of
Padilla to the U.S. Justice Department, which had
indicted Padilla on terrorism charges in U.S.
District Court. (Ever since 9/11, U.S. officials
have had the option of treating people suspected
of terrorism either as enemy combatants or as federal-court defendants.)
Dont forget: Jose Padilla is an American
citizen. Thus, this case continues to hold
ominous implications for the American people,
especially when Judge Cookes ruling is
considered in conjunction with the ruling of the
Fourth Circuit Court of Appeals that upheld the
governments enemy-combatant designation for
Americans as part of its war on terrorism. That
means that whatever the government has done and
continues doing to Padilla and, for that
matter, every other enemy combatant in its war
on terror, it has the authority to do to all Americans.

This top official in the Justice Department, who
serves as its liaison to the White House, is now
refusing to answer any congressional questions
about the US attorneys scandal. You know, the
one in which George and Dick and Karl and Alberto
have been hiring and firing federal prosecutors
based on their willingness to politicize the
legal system. That scandal (its so hard to keep track of them these days).
So Goodlings lawyer has just announced that his
client will be invoking her Fifth Amendment right
against self-incrimination even though, mind
you, she didnt do anything wrong! rather than testifying to Congress.
Fifth Amendment? Fifth Amendment? You mean
like, the Bill of Rights? That Fifth Amendment?
Doesnt she know that the Fifth Amendment has been suspended?
Doesnt she know that all those amendments have been suspended?

Federal Reserve: Hiding 9-11 Evidence?
The story is about William Bergman a senior
analyst at the Federal Reserve Bank of Chicago
whose employment with the Bank was abruptly
terminated after he sought answers to a question
relating to an investigation he had been directed to undertake.
According to the Muckraker Report, Bergman had
noted that the Board of Governors of the Federal
Reserve had issued supervisory letters to the 12
Reserve Banks in the weeks after September 11,
2001 urging scrutiny of suspicious activity
reports in tracking terrorism activity and
financing. However, Bergman also noticed that
the Board of Governors had issued a similar
letter, albeit one that did not refer explicitly
to terrorism, on August 2, 2001. According to
Bergman, terrorism and terrorist financing were
known to be part of suspicious activity
however, and the August 2, 2001 supervisory
letter clearly called for scrutiny of suspicious
activity, which implies and includes the tracking
of terrorism activity and financing. In
December, Bergman called the staff of the Board
of Governors to ask why the Board had issued the August 2, 2001 letter.
Within two weeks Bergmans assignment was
abruptly terminated and his credentials canceled and he was forced to resign.

Proof of US orchestration of death squads killings in Iraq : War Crime
Probably everyone remembers the discovery of the
Jadiriyah detention facility in November 2005. US
troops were reported to have uncovered the prison
in their hunt for a missing person, only to
discover some 170 detainees in horrific
conditions, many of them clearly the victims of
obscene tortures. Although it was admitted that
the facility belonged to the Interior Ministry
and that the detainees were held by a secretive
Interior Ministry force known as the Special
Investigations Unit, the story was quickly
shuffled away as yet another example of the work
of Shiite militiamen, in this instance, as was
the vogue at that time, the Badr Brigade [1].

Counting the cost : War Crime
The figures have now been vindicated by the
government's own advisers. It's time we held our
leaders to account for the 650,000 Iraqi dead.
Our collective failure has been to take our
political leaders at their word. This week, the
BBC reported that the government's own scientists
advised ministers that the Johns Hopkins study on
Iraq civilian mortality was accurate and
reliable. This paper was published in the Lancet
last October. It estimated that 650,000 Iraqi

Khalilzad's bogus talks with Iraq's resistance
The Times, in its farewell paeon to departing
Ambassador Khalilzad, headlines the least-secret
secret of his tenure in Baghdad: that he held
talks with representatives of Iraq's resistance.
That's pretty much correct, although Chalabi
ignores the reality that the central demand of
the resistance (the non-Al Qaeda-linked
mainstream resistance) is the withdrawal of U.S.
forces from Iraq, in exchange for which they're
willing to declare a ceasefire. The Bush
administration, of course, isn't willing to consider that.
Interesting, though, that the Times calls Chalabi
a "friend of Mr.Khalilzad." Also, in its piece,
the Times forthrightly calls Khalilzad a
"neoconservative," which describes him exactly.
(At a speaking engagement last fall, when I
called Khalilzad a neoconservative, I was
strongly criticized for saying so by Judith
Kipper.) In any case, neocon Khalilzad, friend of Chalabi, is leaving Iraq.
