Peneroka Palong 9 berjaya halang injuksi kontraktor Felda Keadilan Daily 8 Jun 2011, JEMPOL: Seramai 36 peneroka dari Felda Palong 9 dekat sini berjaya menghalang permohonan injunksi kontraktor lantikan Felda untuk kerja penebangan dan membeli pokok getah di tanah mereka.
Peneroka tersebut memfailkan afidavit balas di Mahkamah Tinggi Seremban Januari lalu untuk mencabar permohonan injunksi berkenaan. Menurut Setiausaha Biro Masyarakat Felda dan Orang Asal KEADILAN, Rebin Berham, keputusan oleh Hakim Datuk Zulkifli Bakar itu semalam sangat bermakna dan bersejarah bagi semua peneroka di seluruh negara yang berjuang menuntut keadilan dan hak mereka yang ditindas selama ini. “Felda yang bersikap angkuh dan sombong telah menafikan hak peneroka sebagai tuan tanah dan pemilik kayu getah untuk mengurus dan menjual kayu getah secara sendiri atau berkelompok (tidak melalui felda). “Sikap felda yang tidak membenarkan peneroka berurusniaga atau menjual kayu sendiri menunjukkan tindakan yang tidak profesional dan menafikan hak asasi peneroka. Ini adalah bertentangan dengan undang-undang GSA (Akta Penempatan Berkelompok) 1960,” katanya dalam satu kenyataan. Rebin yang juga Penyelaras Warga Felda Prihatin berkata, sebelum ini Felda menjual kayu getah peneroka Felda Palong 9 hanya pada kadar RM33,000 sedangkan peneroka boleh menjual dengan harga RM46,000 setiap sepuluh ekar. “Kerugian RM13,000 setiap peneroka adalah perbezaan yang amat besar dan oleh itu mereka berhak untuk menentukan kepada siapa kayu hendak dijual. “Semoga kemenangan ini menjadi inspirasi di dalam perjuangan dan medan pertempuran menuntut hak peneroka di dalam PRU (pilihan raya umum) ke 13 nanti,” kata Exco Angkatan Muda KEADILAN itu lagi. http://www.keadilandaily.com/?p=14961 Felda settlers win again Zefry Dahalan | June 8, 2011 A Seremban High Court judge says they can appoint their own contractors to clear their land. SEREMBAN: Another judge has affirmed the right of Felda settlers to appoint their own contractors to clear their plantations for re-seeding. The Seremban High Court yesterday gave victory to the settlers of Felda Palong 9, dismissing a suit brought against them by Evergreen Sdn Bhd, the company that got the job from the Felda management to clear the land. Evergreen was trying to prevent the settlers from appointing contractors offering more money. The judgment appears to be part of a trend of decisions favouring settlers since last year’s Federal Court dismissal of Felda’s appeal against the Kota Baru High Court’s award of damages to the settlers of Kemahang 3, who had sued the authority for manipulating palm oil grading. Subsequently, settlers in Sungai Koyan 2, Sungai Koyan 3 and Raja Alias 2 also won their cases against Felda. The case that ended yesterday involved 30 settlers who plant rubber. Judge Zulkifli Bakar gave his decision in chambers. PKR deputy secretary-general T Kumar, one of the lawyers for the settlers, said they could now appoint their own contractors to clear the land and take the lumber. He said they had collectively decided on a contractor who was offering RM50,000 for each acre. Evergreen’s price was RM33,000 an acre. In dismissing Evergreen’s suit, the judge ordered the company to pay RM15,000 in costs.
