The tools archive contains the build tools you need to compile Xerces from 
source (and execute other targets in build.xml).  The old xercesImpl.jar 
contained in there is for bootstrapping the build; not meant to be used for any 
other purpose.

With regards to the copyright statement, I believe that only applies to 
releases after November 1, 2006. Looks like Ant 1.6.5 [1] was released prior to 
that (June, 2005).  Previously copyrights were in each of the source files [2].
