The fact that GPLv2 does not have patent provisions is false. I see this argument continuously repeated, but the point seems different:

Clearly the point is controversial, but every time I see this argument in a discussion I ask "so, Linux is GPLv2, does this mean that Linux can be brought down by patents?" and nobody answers. Linux being brought down by a patent would probably be the end of open source, for the huge emotional impact it would have. So I assume it's an argument that people shouldn't ignore, right?
