My observations are that:

Samsung:

 * had more annual revenue than Apple and Oracle put together last year
 * is not being sued by anyone else over phones right now

HTC:

 * is a relatively small player
 * already has their hands full in a patent suit with Apple

Ignoring any (possibly quite valid) technical factors that Samsung might
have been chosen for, this looks like a wise business move for Google. I'd
be surprised to see new lawsuits filed over the Nexus S.

Based on this reasoning, you might also see LG producing a Nexus L in 2013.
